The symbol R within a circle - ® - beside a mark indicates that it is a registered trade mark. It is an offence to use this symbol if the mark is not registered. If the mark is registered in the United Kingdom you can use the symbol throughout all 27 European Union countries. The Courts have held that it is unreasonable for the owner of a registered trade mark to produce different packaging or advertising materials when the European Union is a single market for free movement of goods and services.

Did you know…?
This sign - ™ - has no legal significance but it is used by businesses to indicate that the mark is a trade mark. It is prudent to check with a trade mark attorney before adopting this symbol, especially if you have not applied to register the mark, so that you do not unwittingly infringe the registered trade mark of another party.

In the United Kingdom the ownership of the copyright in an artistic work (for example, a logo) remains with the design agency or freelance designer until it is assigned in writing to you…..even if you commissioned and paid for the work.

CTM Did you know…?
A Community Trade Mark protects a mark in all 27 European Union countries. A single application is filed with the Community Trade Marks Office (OHIM). Fees at registration are no longer payable which means that a straightforward application in up to three classes - which does not meet with objections or opposition – could cost less than £50 per country (excluding VAT but inclusive of official fees and attorney fees). Registration is for ten years and can be renewed as a unitary registration for further ten year periods provided the mark is used. (January 2012).
